Public Comment Period Now Open for CMS’ Nursing Home Minimum Staffing Requirements Rule

September 6, 2023

Learn more about the proposed rule.

The Centers for Medicare & Medicaid Services (CMS) is seeking comments on a proposed rule that would establish minimum staffing requirements for nursing homes. Research consistently shows a link between resident safety, care quality, and stable staffing in nursing homes; understaffing contributes to inadequate and unsafe care.

The proposed rule is a critical part of the Biden-Harris Administration’s effort to strengthen our nation’s system of providing the long-term services and supports needed by many older adults and people with disabilities. It complements the Biden-Harris initiatives to expand access to home and community-based services (HCBS), including a $25 billion investment to expand Medicaid-funded HCBS through the American Rescue Plan, proposed regulations to strengthen the direct care workforce, and expanding the Money Follows the Person program that helps residents transition back home from nursing homes.

A comprehensive fact sheet about the proposed nursing home rule can be found on the White House website.

Comments are due by November 6, 2023.
